CONSERVATION COMMISSION

Present: Richard Andrus, David Dempsey, Christopher Blair and Betty Pixley
The meeting convened at 6:00p.m.
Close, 10 Laurel Banks Lane – RDA (D. Dempsey is the project manager)
Chris Tryon of Kelly Granger and Parsons was present to review the project. The applicant failed a title v inspection and is looking to replace the failed system. The will be a jet bat system. The project as submitted was approved as a N3.
Kupperman – 16 Laurel Banks – RDA (B. Pixley is the project manager)
Nick Anderson of Berkshire Engineering was present to review the project. The applicant is upgrading their septic system with a jet bat septic. The tank locations were limited due to several surrounding wells. The Commission approved the project as submitted as a N3. Nick advised the Commission that as of right now the Board of Health has not approved this system.
Doane Family Cottage – 60 Sylvan Rd – reconstruct existing dock and pump house and dock construction NOI#230-0259 (R. Andrus is the project manager)
Nick Anderson of Berkshire Engineering was present to review the project. Nick stated that in this particular case the Building Commission has stated that this will not require a building permit; the Commission was surprised by this and suggested that the applicant get something in writing. The Commission approved the project as submitted and required that they be contacted to review all work. The Commission is still awaiting an opinion from the Natural Heritage.
Rissman – 48 Tyringham Rd – NOI – remove and replace dock (C. Blair is the project manager)
Rob Vanderkar of Guntlow & Associates was present to review the project. The Commission is still awaiting an opinion from the Natural Heritage. The Commission approved the project as submitted.
For Discussion:
1. Susan Bacheldor requested that the Conservation Commission refrain from any further comment on her situation on Laurel Banks as the situation has now become a civil matter and she and her neighbor will be heading to court to resolve the issue. The Commission agreed to wait to hear further from Ms. Bacheldor’s attorney.
2. Mail was reviewed which included:
a. A request from 68 Tyringham Rd to replace their existing dock. The Commission will respond that a RDA needs to be filed.
b. ZBA application for 47 Old Beartown Mtn Rd. The Commission approved it as long as it is a temporary situation.
3. Minutes from 5.10.11 were approved as written.
4. The Commission received a request from Tom Whalen on the Levkoff property stating that they have met the requirements set forth by the Con Comm and would like something in writing stating that. The Commission reviewed their files and discussed this further. The Commission determined that there are still items that need to be met/fulfilled. A letter will be sent to this effect.
